These Terms of Service (“Terms”) are a binding agreement between you and Atypical Co. (“Atypical,” “we,” “us,” or “our”) governing your use of the Acanon website at acanon.atypical.co and the Acanon scanning service (together, the “Service”). By accessing or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. Who may use the Service
You must be at least 16 years old and able to form a binding contract. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization to these Terms, and “you” includes that organization.
2. What the Service does
Acanon analyzes an application binary you provide and returns a resistance score and a report describing how exposed the software is to reverse engineering, extraction, and cloning, along with suggested fixes. The scan is static: we measure the bytes and never execute your binary. We may offer additional paid hardening services; those may be governed by a separate agreement.
3. Your binary and the right to scan it
You may only submit software that you own or are expressly authorized to analyze. By uploading a binary, you represent and warrant that you have all rights and permissions necessary to do so and that your submission and our analysis of it do not violate any law, contract (including any license or anti-reverse-engineering term), or third-party right. You are solely responsible for what you upload.
You retain all rights in the binaries you submit. You grant us only the limited, non-exclusive license needed to process your submission to provide the Service to you (uploading, parsing, scoring, and generating your report). We do not use your binary to train models, and we delete it after analysis as described in the Privacy Policy.
4. Acceptable use
You agree not to:
- Submit software you do not own or are not authorized to analyze;
- Upload malware or content intended to harm the Service or other users, or use the Service to develop or distribute malware;
- Use the Service to infringe, misappropriate, or violate any intellectual-property, privacy, or other right;
- Attempt to breach, overload, probe, or circumvent the Service’s security, rate limits, tokens, or isolation;
- Reverse engineer, scrape, or build a competing service from the Service, except to the extent this restriction is prohibited by law;
- Resell or commercially exploit the Service or reports without our written permission.
5. The score and report are informational
The score and report are an automated assessment provided for informational purposes only. They are not a certification, warranty, or guarantee of security, and they do not promise that your software cannot be reverse engineered, cracked, or cloned. Acanon can make reverse engineering dramatically harder, but no protection is absolute; “nearly impossible” is not “impossible.” A good score does not mean your software is secure, and you remain responsible for your own security decisions. You use the score and report at your own risk and should obtain independent professional advice before relying on them.
6. Intellectual property
The Service, including the website, the scoring engine, and all related text, graphics, and software (but not your submitted binaries), is owned by Atypical Co. and its licensors and is protected by intellectual-property laws. We grant you a limited, revocable, non-transferable license to use the Service and to use the report we generate for your own internal and business purposes. The report may describe our methodology at a high level; our methods and engine remain our confidential property.
7. Email communications
If you request an emailed report, you consent to receive that email and related messages about Acanon. You can unsubscribe at any time using the link in any such email or by emailing hello@atypical.co.
8. Disclaimer of warranties
THE SERVICE AND ALL SCORES AND REPORTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY SCORE OR REPORT IS COMPLETE OR ACCURATE.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ATYPICAL CO. AND ITS OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US FOR THE SERVICE IN THE PRECEDING TWELVE MONTHS OR ONE HUNDRED U.S. DOLLARS (US$100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN OF THESE LIMITATIONS, SO SOME MAY NOT APPLY TO YOU.
10. Indemnification
You agree to indemnify and hold harmless Atypical Co. from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, your submissions, or your breach of these Terms or of any law or third-party right, including any claim that you lacked the right to submit a binary you uploaded.
11. Suspension and termination
We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms or to protect the Service. You may stop using the Service at any time. Sections that by their nature should survive termination (including sections 3, 5, 6, and 8 through 13) will survive.
12. Governing law and disputes
These Terms are governed by the laws of the State of Oregon, United States, without regard to its conflict-of-laws rules. You and Atypical Co. agree to the exclusive jurisdiction of the state and federal courts located in Oregon for any dispute not subject to arbitration, and you waive any objection to venue there.
13. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Service after changes take effect means you accept the revised Terms.
